The intention of this site is to provide an online food ordering service by connecting consumers with a network of food outlets. When you submit an order on this site, EatCity.ie sends this order via our network to your chosen outlet. If you have entered a mobile number we may text you to let you know the progress of your order. All food preparation either for collection or delivery will be the responsibility of the chosen outlet.



This website (the "Site") is owned and operated by EatCity.ie which is solely owned by Captiva Software Ltd. Your access to, use of, placing of an order, linking to the Site, use of software or downloading software on the Site (collectively, your "Access") is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained on this page and elsewhere on the Site ("Terms of Use"). Terms of Purchase


The final charges for your order may be different than those stated on the website. EatCity.ie does not assume any responsibility or liability for the actions, products, and content of any third parties related to the creation or delivery of your order. You agree to pay all fees and charges incurred in connection with your purchases,( Vat is included in the price) at the rates in effect when the charges were incurred. We may require additional verifications or information before accepting any order.



METHODS OF PAYMENT:



Cash
By selecting CASH as a method of payment, you agree to provide the restaurant payment in the form of Euro € upon receipt of your order.


Credit Card

By selecting CREDIT CARD as a method of payment, you agree that you must be authorised to use the credit card presented as a method of payment. Prior to the purchase of any goods or services on our website, you must provide us with a valid credit card number and associated payment information including all of the following: (i) your name as it appears on the card, (ii) your credit card number, (iii) the credit card type, (iv) the date of expiration and (v) any activation numbers or codes needed to charge your card. If EatCity.ie does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by EatCity.ie or its agents. The final charges on your credit card may be different than those stated on the website.



Return Policy


If you have selected credit card payment and your order has not arrived, please contact EatCity.ie Customer Service immediately via email at info@eatcity.ie and include the order number and restaurant name. All sales are final unless order problems/issues are confirmed with our restaurant partners or otherwise determined by EatCity.ie, at its sole discretion, to be actionable. In such cases, EatCity.ie will confirm with the restaurant that the food was not delivered and we will refund the money on your card. All order problem/issue inquiries must be received within 24 hours of the order date listed on your order confirmation email. EatCity.ie will issue no cash refunds

Any disputes, claims or proceedings arising out of or in any way relating to the Content or the Site shall be governed by the laws of Ireland. The Irish Courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in any way relating to the Content or the Site. Without prejudice to the foregoing, eatcity may seek provisional or protective relief in the courts of another State prior to, during or after any substantive proceedings have been instituted in Ireland and eatcity may bring enforcement proceedings in another state on foot of an Irish judgment.
If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

The Site is intended to be accessed by persons located in Ireland. Eatcity makes no representation that the Content and/or the service provided by the Site are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.
Eatcity may at any time and without liability modify, suspend or discontinue the Site or any Content (or any part or specification thereof), with or without notice, for any valid technical, operational, legal or commercial reasons.
